Foundation & On-Site Infrastructure Works, hereinafter referred to as the Project, by Vietnam International Township Development JSC., hereinafter referred to as the Employer Tenders have been invited 1.2 These Instructions prescribe the procedures to be followed during the period of Tender preparation until the Employer either enters into a Contract with the Tenderer or advises him that the Employer does not intend to so These Instructions to Tenderers shall not form part of the tenderer’s offer, nor be considered as part of the defined words “Tender” or “Contract” Các dẫn thể trình tự Điều Kiện Hợp Đồng có nghĩa sử dụng dẫn 1.4 The Tenderer shall bear all costs incurred in the preparation and submission of the Tender, including visits and other actions mentioned or implied in these reserves the right to accept or reject any Tender, or to annul the tendering and reject all Tenders, without incurring liability to any Tenderer and without being obliged to inform any Tenderer of the INTERNATIONAL TOWNSHIP DEVELOPMENT JSC The Tenderers are to treat their tender as strictly confidential and shall not communicate their prices to a third party nor reveal anything about it to the public or the press Các Nhà Dự Thầu phải bảo mật Hồ sơ thầu không chia sẻ thông tin giá chào thầu cho bên thứ ba khơng tiết lộ điều cho cơng chúng hay báo chí 1.7 The pricing of the Tender including all rates and prices therein shall be in Vietnam Dong (VND) and all payments made under any Contract issued as a result of the tender shall be in Vietnam Dong (VND) Giá bỏ thầu bao gồm tất chí phí đơn giá trường hợp tính Đồng Việt Nam (VND) tất chi trả thực theo Hợp đồng Đồng Việt Nam (VND) 2.1 Joint Operation or Joint Venture or Branch Office Tenders/ Hồ sơ thầu Liên doanh hay Văn phòng chi nhánh Subject to the prequalification of their partnership, Tenderers may submit a Joint Operation or Joint Venture Tender during the tendering process for execution of the Works of the Project Để phục vụ việc đánh giá liên doanh, Nhà dự thầu trình hồ sơ dự thầu liên doanh trình đấu thầu thực công việc Dự án 2.2 The Joint Operation/Joint Venture partnership shall be properly constructed and constituted according Vietnam law All members of the partnership shall be legally liable, jointly and severally, during the bidding process and until issuance of the Performance Certificate should they be appointed as Contractor A Joint Operation/Joint Venture agreement shall be submitted with the tender Thành viên liên doanh thành lập phù hợp với luật pháp Việt Nam Tất thành viên phải có trách nhiệm define the legal status of the partners, their relationship, share of responsibilities and identification of the lead partner It must also include provisions on the commitment of the partners to be jointly and severally liable for due performance and have recourse/sanctions within the partnership in the event of the default or withdrawal of any partner The agreement must include arrangements for qualified by official certification to engage or assume responsibility in international construction outside their country of registration Các đối tác nước ngồi phải có chứng đánh giá nghĩa vụ trách sở Công ty mẹ Scope of Tender/ Phạm vi mời thầu 3.1 The Works of this Tender Package are as described in the Drawings and Specifications and Schedules included in The Tender Documents and as generally during the tendering period The Tenderer shall scrutinize each Tender Document immediately upon receipt and shall promptly give notice, to the party who issued the document, of any pages which appear
