Nghiên cứu lý luận kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước; Nghiên cứu kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước số nước giới; Tổng hợp, phân tích đánh giá thực trạng kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước Việt Nam nay; Nghiên cứu, đề xuất phương hướng giải pháp tăng cường kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước Việt Nam Đối tượng phạm vi nghiên cứu Đối tượng nghiên cứu luận án kiểm soát cách có hiệu hoạt động bảo đảm quyền công dân quan hành nhà nước Việt Nam Phạm vi nghiên cứu luận án: - Về nội dung: Luận án nghiên cứu kiểm soát nhà nước xã hội tiến hành hoạt động bảo đảm quyền công dân quan hành nhà nước Cụ thể, (1) kiểm soát mang tính quyền lực nhà nước (gồm: giám sát Quốc hội; giám sát Hội đồng nhân dân; giám sát Tòa án nhân dân; kiểm toán Kiểm toán nhà nước; kiểm tra, tra hệ thống quan hành nhà nước) (2) kiểm soát mang tính xã hội (gồm: kiểm tra, giám sát Đảng Cộng sản Việt Nam; Phương pháp thống kê; Phương pháp so sánh; Phương pháp phân tích tổng hợp; Phương pháp quy nạp Câu hỏi nghiên cứu giả thuyết khoa học Trong trình tìm hiểu vấn đề, có 02 câu hỏi nghiên cứu đặt ra: Hoạt động bảo đảm quyền công dân quan hành nhà nước Việt Nam nhiều hạn chế có phải hoạt động chưa kiểm soát tốt hay không? Làm để nâng cao hiệu kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước Việt Nam nay? Xuất phát từ 02 câu hỏi trên, 02 giả thuyết khoa học đưa là: Kiểm soát tốt hoạt động bảo đảm quyền công dân quan hành nhà nước tạo tiền đề, sở để thực hóa quyền công dân; Để kiểm soát tốt hoạt động bảo đảm quyền công dân quan hành nhà nước cần trọng đến việc hoàn thiện thể chế kiểm soát, tăng cường lực chủ thể kiểm soát, tối ưu hoá quy trình, thủ tục, nâng cao hiệu chế phối hợp kiểm soát Những đóng góp Luận án Luận án có đóng góp lý luận sau: (1) Đưa khái niệm hoạt động bảo đảm quyền công dân quan hành nhà nước, phân biệt hoạt động bảo đảm quyền công dân với hoạt động bảo vệ quyền công dân quan hành nhà nước Trình bày nội dung hoạt động bảo đảm quyền công dân quan hành nhà nước (2) Đưa khái niệm kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước, trình bày khái niệm kiểm soát mang tính quyền lực nhà nước, khái niệm kiểm soát mang tính xã hội Làm rõ cần thiết phải kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước Khái quát cách có hệ thống phương thức kiểm soát (3) Đưa ý tưởng việc thành lập Ủy ban chuyên trách hoạt động giám sát Quốc hội Đưa kiến giải việc xây dựng đạo luật chung giám sát nhân dân vấn đề thực hóa việc thành lập Ủy ban lâm thời Quốc hội cần thiết Ngoài ra, Luận án có đóng góp thực tiễn như: (1) Cung cấp luận cho việc hoàn thiện thể chế, nâng cao lực chủ thể, đổi cách thức tổ chức thực kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước (2) Những giải pháp đưa áp dụng thực tiễn góp phần hạn chế tha hóa quyền lực máy hành nhà nước nhằm làm cho quyền hành pháp thực khoa học, hiệu lực, hiệu quả, thực bảo đảm tốt quyền lợi hợp pháp công dân Ý nghĩa khoa học thực tiễn đề tài Về mặt khoa học, Luận án có ý nghĩa sau: (1) Bổ sung, hoàn thiện thêm, làm phong phú thêm lý luận hoạt động bảo đảm quyền công dân quan hành nhà nước kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước Góp phần nâng cao nhận thức vai trò tầm quan trọng kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước (2) Góp phần xây dựng sở khoa học cho việc tăng cường kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước Việt Nam Về mặt thực tiễn, kết nghiên cứu Luận án có ý nghĩa sau: (1) Làm tài liệu phục vụ cho đào tạo chuyên ngành Quản lý công chuyên ngành khác Học viện Hành Quốc gia (2) Làm tài liệu tham khảo có giá trị cho cá nhân, quan, tổ chức làm công tác nghiên cứu, giảng dạy, học tập quản lý công (3) Làm tài liệu helping National Assembly Standing Committee set up plan supervision program; Chapter presents current status of institutions control, 51 4.2.2.2 Realization the establishment of the Interim Commission of the National Assembly when necessary In many countries, parliaments can establish interim committees to conduct an investigation, review of particular, government’s special cases In our country, the establishment of the Interim Commission of the National Assembly has been constitutional and legislative However, this is difficult to implement and has never been done in our National Assembly For the realization (when necessary) during the process of supreme supervision of the National Assembly, we need to solve some problems as follows: reducing the difficulty of establishing the conditions; researching again in the direction of adding members who are qualified, reputable, not among the National Assembly deputies; clarifying the provisions on the responsibility for providing information and protecting witness of negative cases; clarifying the conditions for ensuring the operation of the Interim Committee; clarifying the right to investigate the individual transactions, the relationship between investigation activities of Committee with investigation activities of public security organs and with other inspection forms, other supervision forms 4.2.2.3 Establish a Committee specializing for supervising activities of the National Assembly Legislative power and supreme supervision power are equivalent in terms of aspects are both fundamental rights of the National Assembly Meanwhile, National Assembly has a Committee specializing in legal issue So, we can see it is necessary to establish a Committee specializing in supervision of the National Assembly This Committee has duties and powers as follows: examining proposals and recommendations of the agency, organizations, National Assembly deputies about supreme supervision activities; kiểm soát hoạt động quan nhà nước; kiểm soát hoạt động quan hành nhà nước; kiểm soát hoạt động bảo đảm quyền công dân quan hành nhà nước 1.2 Khái quát kết nghiên cứu liên quan đến đề tài luận án vấn đề đặt cần tiếp tục nghiên cứu 1.2.1 Khái quát kết nghiên cứu liên quan đến đề tài luận án Thứ nhất, nhiều nghiên cứu tập trung làm rõ vấn đề lý luận quan trọng liên quan gián tiếp đến đề tài Luận án như: kiểm soát hoạt động quan nhà nước;
